Ensure bias free legal stand on Article 35A, PDP urges Governor

Taking a strong exception to the legal position taken by Tushar Mehta, Additional Solicitor General of India (ASG), in the Supreme Court during the hearing on Article 35A, the PDP on Monday appealed to the newly appointed Governor to ensure a “bias-free and strong legal position of the state government”.

In a statement, Rafi Mir, PDP chief spokesperson, said the PDP had always stood up for retaining and empowering the constitutional powers to Jammu and Kashmir and they strongly condemned the remarks made by the leading counsel in the matter.

“The PDP, while in government, engaged top legal luminaries to ensure that the state government had a strong legal position while defending Article 35A. Former Chief Minister and PDP president Mehbooba Mufti periodically reviewed the progress of the case, directing the state law department to file appropriate and crystal clear response to ensure that the sentiments of the people were honoured,” said Mir.

He said while the proceedings in the case related to Article 35A were pending, the power of taking the legal recourse of the state government was transferred directly to the hands of the Governor after the fall of PDP-led government and now, the Governor was morally bound to ensure that the stand of the newly appointed ASG was in accordance with the will of the people.
