– The proposed Waqf (Amendment) Bill, 2024, has sparked fierce criticism from political leaders in Jammu and Kashmir, who have labeled it a “conspiracy against Muslims” and an infringement on their faith. The bill, which seeks to amend the Waqf Act of 1995, has ignited debates over its implications for minority rights and religious governance.

Opposition Voices

Several prominent leaders have voiced their concerns:

  • Sajad Lone, chairman of the People’s Conference, described the bill as a “blatant interference in our faith aimed at divesting rightful custodians of their authority.” He called it “yet another right-wing trespass”.
  • Mehbooba Mufti, president of the People’s Democratic Party (PDP), accused the BJP government of targeting Muslims through systematic actions, including lynchings and the destruction of mosques. She stated, “The bill is a continuation of that process”.
  • Omar Abdullah, vice president of the National Conference (NC), criticized the bill for singling out one religion and targeting charitable institutions like Waqf. He emphasized that his party would oppose the legislation in Parliament.

Concerns Over Minority Rights

Critics argue that the bill mirrors the J&K Reorganization Act of 2019, prioritizing centralized control over community properties. PDP legislator Waheed Ur Rehman Para warned that the amendments would dilute the control of Muslim society over Waqf assets.

Kashmir’s chief cleric, Mirwaiz Umar Farooq, expressed disappointment over the lack of consultation with Muslim organizations. He stated that the bill undermines the rights and institutions of crores of Muslims in India.

Support for the Bill

BJP leader and J&K Waqf Board Chairperson Darakhshan Andrabi defended the bill, claiming it would benefit poor Muslims by addressing irregularities in Waqf property management. She argued that the amendments would ensure transparency and uplift the Muslim community.
